Proposition 65 is the "Safe Drinking Water and Toxic Enforcement Act of 1986", a ballot initiative passed overwhelmingly by California residents in 1986. Since its enactment, there have been numerous lawsuits which resulted in the reduction of carcinogenic and reprotoxic chemicals by significant reformulations of consumer products containing such chemicals.
Over the years, Prop 65 has concluded consent agreements in a number of consumer products including but not limited to bibs, bicycles, brass-containing products, cookware, cosmetics, exercise mats, ceramicware and glassware, clothing, faux leather furniture, headphone cables, jewelry, lunchboxes, luggage and accessories, poker chips and personal carrying products.
A recent Prop 65 settlement has been reached for DEHP in fashion accessories such as apparel, footwear, jewelry and cases for mobile electronic devices intended primarily for the general public.
Under the settlement, DEHP is required to be reformulated to no more than 1000 ppm. The settlement also allows Opt-in Settling Defendants (persons and entities who are not Initial Settling Defendants under this Consent Judgment and who wish to subscribe to the terms of this settlement)
