USA California Proposes Enhanced Proposition 65 Warning label Act

California's Office of Environmental Health Hazard Assessment (OEHHA) has proposed to amend the warning requirements in Proposition 65. Proposition 65 has specified“No person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the state to cause cancer or reproductive toxicity without first giving clear and reasonable warning to such individual”.

The new amendment modified the requirements of the warning label. It provides more specific guidance on the content and format of warnings for a variety of exposure situations, and corresponding more methods for providing those warnings. It also adds a specific section to the regulations addressing the relative business responsibilities for providing warnings.

Besides, the name of the following listed chemicals shall be presented in the warning text where a warning is being provided as required:

1. acrylamide

2. arsenic

3. benzene

4. cadmium

5. carbon monoxide

6. chlorinated tris

7. formaldehyde

8. hexavalent chromium

9. Lead

10. mercury

11. methylene chloride

12. phthalates

The comment period for the amendment will endon April 8, 2015. The amendment will become effective two years after the date of its adoption.
