Turkey has sent its draft of Toy Safety Law to the country’s ministry for EU Affairs. It is said that this draft bases on the EU toys safety directive 2009/48/EC. The final version is expected to be effective in 2013 June to substitute the previous toy safety law.
In light of producers’ obligation under this draft, producers shall:
1. Make sure that toys placed on Turkey market are designed and manufactured on the basis of requirements specified under this draft;
2. Prepare and sign the “AT” conformity declaration and insert EC symbol on toy placed on the Turkey market;
3. Keep the technical documents and “AT” conformity declaration for 10 years;
4. Take consideration on risks caused by toys and examine the sample launched on the market. If unconformity of toy is found, keep records of them or remove them from the market, as well as keep relevant distributors informed;
5. Attach type, model and serial numbers as well as producer’s name, registered commercial names/bands and address on toy. Except when the size or the structure of the toy is inappropriate, marking shall appear on the package or in accompanying documents;
6. Prepare manuals and any other information in Turkish.
Otherwise, it should be noted that the responsibilities of producer and importer are the similar except some non-material differences.
